Calibrate was engaged by a Head Contractor to provide commercial advisory services on a high-risk project under onerous contract conditions.
Following our engagement, our team undertook a detailed review of the executed contract and developed a practical contract management strategy, along with a briefing session.
The strategy took account of:
- the contractual risk profile
- the client’s objectives in managing contractual risk; and
- its relationship with the project owner.
Upon completion of our review, we held a presentation and briefing session for the core project team outlining key contractual risks and proposed management strategies, along with opportunities to secure further entitlements. This was followed up by a workshop to discuss the project delivery risks and how they would be addressed in the day-to-day management of the contract.
As part of our deliverables, we also provided the team with several contract management tools, including tailored document templates and process diagrams to assist the commercial team in effective contract administration. We then assisted the project team with administering the contract, and provided claims management services for a range of complex issues.
OUTCOME
Our client was able to effectively manage a difficult client utilising the advice and tools provided by Calibrate. In particular, it was able to agree upon a range of complex extension of time claims as a result of accurately administering the contract and preparing strong records in support of its entitlements. The Project performed well commercially and was the subject of a negotiated agreement between our client and the principal.
