Calibrate was engaged by a major infrastructure subcontractor to prepare disruption claims for the recovery of increased labour costs that arose on two Sydney Metro projects due to losses in trade labour productivity.
Our team provided advice on the data required to properly prepare and substantiate the claims for submission to the Main Contractor Additionally, we carried out project staff interviews and undertook a forensic review of contemporaneous project records including programs, project labour reports, site diaries, meeting minutes and correspondence to identify causative factors, which included:
- water ingress;
- delayed access;
- re-sequencing; and
- confined space working.
Our analysis was successful in linking cause and effect, where the cost of the various disruption events could be clearly substantiated and quantified into the following primary categories:
- stop-start events;
- reduced labour productivity; and
- overtime hours.
We undertook a measured mile analysis, establishing rates of progress in unimpacted areas to demonstrate lost labour productivity in impacted areas (and in turn to quantify the extent of lost productivity across the project).
OUTCOME
Our efforts culminated in a well-articulated and properly detailed claim submission for lost productivity that strengthened our clients overall claim position on both projects. Ultimately, this led to a substantially increased settlement outcome without the need for formal dispute resolution proceedings or additional SOP claims.
