Calibrate was engaged by a Main Contractor to prepare a strategy concerning timely project completion, reducing exposure to liquidated damages under the head contract, and recovering proper entitlements to EOT and delay costs.
We first reviewed the scope of the project and contract documentation before undertaking the following:
- Project audit to assesses progress achieved to date and validate the critical path;
- Recommendations list to regain momentum on site including prioritising resolution of performance issues with key subcontractors (often involving outstanding commercial matters);
- Assessment of project staff capability and capacity, including recommendations;
- Advice concerning best practice in planning and programming to drive performance on site;
- Claims management tasks. Including:
- preparation of an EOT and positioning strategy for implementation;
- preparation of EOT claims in accordance with the strategy; and
- presentation of all claims to the client to achieve settlement of an extended date for Practical Completion.
OUTCOME
The majority of Calibrate’s recommendations were taken up by the contractor and as a result, performance issues were resolved, along with staffing and subcontractor issues. A realistic target program was prepared by our team, including the introduction of daily and weekly disciplines to drive progress. The program was generally achieved, and drove timely completion of the remaining works.
All time and cost related claims under the head contract were submitted and settled, resulting in no award of liquidated damages and maximum entitlement of EOT and delay costs.
