Calibrate prepared submissions and evidence in support of over $50m in claims with a successful outcome in adjudication.
ENGAGEMENT
Calibrate was involved in the preparation of claims arising from major design changes and restricted access conditions. Calibrate reviewed the existing claims and revised and refined them for dispute resolution purposes. This included the preparation of variation cost claims, delay analyses and prolongation cost identification. The claims addressed exceeded $50 million in value.
Calibrate undertook detailed analyses of direct costs, disruption costs and prolongation costs arising from major change events. We also prepared detailed submissions and supporting evidence for the claims.
Our team was closely involved with the preparation of materials for multiple Adjudication Applications, assisting the external legal teams with the preparation of lay evidence and submissions to support detailed costings and arguments for entitlement.
Calibrate managed and worked with large teams of internal and external resources, including the client’s engineers and quantity surveyors, forensic programmers, external quantity surveyors, the client’s in-house legal team, external legal advisors and several barristers.
OUTCOME
The claims prepared by Calibrate and submitted to Adjudication were determined at their full claimed value. This in turn resulted in the settlement of remaining claims by way of negotiation.
