Calibrate was engaged to identify and prepare claims on a complex Federal Government project for a major defence services subcontractor.
Following investigation and analysis, our team produced a wide variety of contractual claims, including newly identified entitlements under the Contract, to assist in recovering significant losses in both cost and time.
As part of our process, we carried out project staff interviews and undertook a forensic review of contemporaneous project records including programs, QA information, project cost reports, site diaries, daywork sheets, meeting minutes and correspondence to identify causative factors. We also undertook detailed delay analysis on complex delay events that led to recovery of EOT, prolongation costs and disruption (lost trade productivity) costs.
Our findings were able to prove nearly 18 months of critical path delay, with associated prolongation costs. In addition, we demonstrated losses in trade labour productivity by way of a measured mile analysis.
OUTCOME
Calibrate produced a large set of concise claims for use by the client to establish a much-improved commercial position from which to negotiate a better outcome. This laid the foundation for more fruitful commercial discussions that were undertaken in parallel with formal litigation.
